§ 78-81. Prohibited acts.

  • The following activities are declared to be unlawful and in violation of this chapter:

    (1)

    Unlawful deposit of refuse; burying refuse. No person shall deposit on or bury in or cause to be deposited on or buried in any public land, park, street, alley, vacant or unoccupied lot or drainage ditch, any garbage, household debris, building materials, rubbish, litter, scrap tires, filth, carrion, weeds, undergrowth, brush, yard trimmings, or other refuse. No person shall deposit or bury any such materials on or in the property of another without the prior consent of the owner, and then not in violation of other sections of this chapter or any other state or federal laws.

    (2)

    Disturbing container or contents. No person, other then the owner, occupant, or agent owning, holding, or occupying the property whereon refuse is generated, a city employee, or an approved private hauler, shall disturb any refuse container or remove its cover or any of the contents thereof, or cause such refuse container or its contents to be strewn or scattered on the lawns, sidewalks, or streets.

    (3)

    Disposal of certain materials restricted. No smoldering ashes or other smoldering combustible materials residue, building materials, household debris, yard trimmings, or scrap tires shall be placed inside any refuse container or be mixed with any other refuse.
